Welcome to O2Pets. The terms “we”, “us” and “our” refer to O2 PETS TRADING L.L.C. O2 PETS TRADING L.L.C operates this store and website, including all related information, content, features, tools, products and services, to provide customers with a curated shopping experience (the “Services”).

Our store is powered by Shopify, which enables us to provide the Services.

These Terms of Service, together with any policies referenced herein, describe your rights and responsibilities when you access or use the Services.

We reserve the right to discontinue products or limit the quantities available to any person, household, geographic region or jurisdiction.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase the selected products.

O2 PETS TRADING L.L.C reserves the right to accept, reject, limit or cancel an order where reasonably necessary, including in cases of product unavailability, suspected fraud, pricing errors, payment issues or delivery restrictions.

Your order is accepted when we send you an order confirmation or dispatch confirmation, depending on the circumstances.

We must receive and process your payment before dispatching an order. Please review your order carefully before submitting it, as we may be unable to accommodate cancellation requests after dispatch.

If we reject, change or cancel an order, we will attempt to notify you using the email address, billing address or phone number supplied with the order.

You represent and warrant that products purchased through our Services are for lawful personal or household use and not for unauthorized commercial resale or export.

The price charged for a product will be the price displayed at the time the order is placed and will be shown in the order confirmation.

Delivery periods are estimates and may be affected by carrier delays, customs processing, weather, public holidays, incorrect delivery information or other circumstances outside our reasonable control.

We will use reasonable efforts to deliver orders within the estimated period and will notify you where we become aware of a material delay.

You are responsible for providing an accurate and complete delivery address and for ensuring that someone is available to receive the order when required.

Nothing in this section limits any mandatory rights available to you under applicable consumer protection laws.

SECTION 6 — INTELLECTUAL PROPERTY

The Services and their contents, including trademarks, brand names, text, graphics, photographs, product images, videos, audio, designs, layouts and software, are owned by or licensed to O2 PETS TRADING L.L.C and are protected by applicable UAE and international intellectual property laws.

“O2Pets”, our logos, product names, designs and slogans are trademarks or other intellectual property of O2 PETS TRADING L.L.C or its licensors. Shopify’s name, logos and related marks belong to Shopify.

Unless otherwise stated, we do not control or monitor such third-party tools. Access may be provided on an “as is” and “as available” basis, subject to applicable law.

O2Pets is powered by Shopify, which enables us to provide the Services.

However, any purchases you make through our store are made directly from O2 PETS TRADING L.L.C. Shopify is not the seller of our products and is not responsible for fulfilling orders, handling product claims or providing customer support for purchases from O2Pets.

To the extent permitted by applicable law, Shopify and its affiliates are not responsible for injury, damage or loss resulting from products purchased directly from O2 PETS TRADING L.L.C.

Nothing in this section limits any rights or remedies that cannot lawfully be excluded.

You own or have the necessary rights to submit the Feedback;

You have disclosed any compensation or incentive connected with your submission;

Your Feedback does not contain unlawful, abusive, defamatory or malicious content.

Information provided through the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, delivery charges, estimated delivery periods or availability.

We reserve the right to correct errors, update information or cancel an affected order where reasonably necessary.

If an order is cancelled after payment because of an error or unavailable product, the amount paid for the cancelled item will be refunded to the original payment method.

However, to the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis. We do not guarantee that access to the Services will always be uninterrupted, timely, secure or error-free.

Product information provided through the Services is general in nature and does not constitute veterinary diagnosis, treatment or medical advice.

Nothing in these Terms excludes any warranty, guarantee or consumer right that cannot lawfully be excluded under applicable law.

SECTION 17 — LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, O2 PETS TRADING L.L.C and its directors, officers, employees, affiliates, agents, contractors, licensors and service providers will not be liable for indirect, incidental, special, punitive or consequential loss resulting from your use of the Services or products purchased through the Services.

This may include loss of profits, revenue, savings or data, where such loss was not reasonably foreseeable.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for fraud, wilful misconduct or any mandatory consumer rights.

SECTION 18 — INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless O2 PETS TRADING L.L.C, Shopify and their respective affiliates, directors, officers, employees, agents, contractors, licensors and service providers from third-party claims, losses or liabilities resulting from:

Your material breach of these Terms;
Your unlawful use of the Services;
Your violation of another person’s rights;
Content or Feedback submitted by you.

We will provide reasonable notice of an indemnifiable claim where practicable.

Subject to any mandatory consumer rights or jurisdictional protections that apply to you, disputes arising from these Terms or the Services will be subject to the jurisdiction of the competent courts of Dubai, United Arab Emirates.

The headings used in these Terms are included for convenience only and do not limit or otherwise affect the interpretation of any provision.
